1. Acceptance of Terms

Welcome to Uheru. By accessing or using the Uheru platform and website at uheru.com (the "Site") and any related services (the "Services"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any part of the Terms, do not access or use the Site or Services.

These Terms create a binding legal agreement between you and Uheru. We reserve the right to modify the Terms from time to time. Your continued use of the Site or Services after any changes constitutes your acceptance of the updated Terms.

You must be of legal age to form a binding contract in your jurisdiction and have the authority to agree to these Terms.
You agree to provide accurate information and to keep account information current and complete.
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.
We may suspend or terminate access for violations of these Terms or for safety, legal, or policy reasons.

2. Intellectual Property

All content and materials on the Site, including but not limited to branding, logos, app metadata, descriptions, images, text, and the underlying software (the "Site Content"), are owned by Uheru or licensed to us. The Site Content is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, Uheru grants you a limited, non-exclusive, non-transferable license to access and view the Site Content for personal, non-commercial purposes. You may not reproduce, modify, distribute, create derivative works from, display, reuse, or otherwise exploit the Site Content in any manner not expressly permitted by these Terms without our prior written consent.

All trademarks, service marks, and logos displayed on the Site are the property of their respective owners or Uheru. Nothing herein grants license or rights to such marks except as expressly provided.

3. Third-Party Links and Hosting

Uheru operates as an app discovery platform. The applications listed on the Site are hosted on third-party stores, primarily Google Play. The Site provides descriptions, metadata, and direct links to these external stores for discovery and installation. Uheru does not host the apps themselves on uheru.com.

Because the apps reside on third-party platforms, Uheru cannot guarantee their availability, safety, performance, or continued existence. Interactions with external stores are governed by the terms and privacy policies of those third parties, over which Uheru has no control.

4. Disclaimer

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, UHERU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND SECURITY. UHERU DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, NOR THAT ANY CONTENT WILL MEET YOUR REQUIREMENTS.

NEITHER UHERU NOR ITS DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, OR PARTNERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR LIABILITY, IN WHICH CASE SUCH LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

5. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Uheru operates, without regard to its conflict of laws principles. Any disputes relating to these Terms or the Site shall be resolved exclusively in the courts located in that jurisdiction, subject to applicable statutory limitations on enforceability.

6. Modifications and Termination

We may update or modify these Terms at any time. When we do, we will revise the â€œEffective dateâ€ and, in some cases, provide notice through the Site or by other means. Your continued use of the Site or Services after any such changes constitutes your acceptance of the revised Terms. We may suspend or terminate your access to the Site or Services for violations or for safety, legal, or policy reasons, with or without notice.
